Big Pulp's rights to the work
comprise the right to publish the work on www.bigpulp.com
and in a quarterly PDF compilation. The Author agrees
to a six month exclusivity window for internet or
other electronic publication. After six months from
the original posting date (ie : the date the work
appears on the web, not the date of the PDF release),
the author may request that Big Pulp remove the work
from the website, for any reason. The PDF edition
will be kept "in print" and available for
purchase for one year from the original publication
date of the PDF. After one year, rights will extend
on a month-to-month basis, unless and until the author
requests that Big Pulp remove the story from the
PDF. All rights outside the two forms of publication,
including print rights, reside with the Author.
In English, please?
Big Pulp acquires electronic
rights to your work - one publication on the web and
one publication in a PDF file. Print publication
rights remain with you. We do not want to prevent
our authors from taking advantage of print opportunities.
We would only ask that you credit Big Pulp as
the first place of publication.
The six-month exclusivity refers
to web publication. Our goal is to publish original
content that is not available elsewhere on the web.
For example, if your story appears on Big Pulp,
we'd rather you not re-post it on your blog or in another
webzine for six months.
We want to keep as much content
online for as long as possible, so fiction and poems
may be kept online after six months. Authors may request
that we remove their work from the site after six months,
for any reason. For example, if the six-month window
has passed and you want to publish elsewhere and the
site or magazine requests exclusivity, please contact
us.
We also purchase the right to
publish your story or poetry in a PDF version that
will be available for sale on our website for one year
from the publication date of the PDF. After one year,
our rights will renew on a month-to-month basis and
authors may request that we remove the work from the
PDF for any reason.
The Author also warrants and
represents that the Author is entitled to grant the
rights herein granted, that the rights are free and
clear, that the work will not violate any copyright
or any right of any third party, and will not be
contrary to law. The Author agrees to indemnify the
Publisher for any loss, damage or expense (including
reasonable legal fees) arising out of any sustained
claim inconsistent with any of the above warranties
and representations. Further, the author verifies
that no actual persons living or dead are referenced
in the work, and that no references are libelous
or slanderous. Exception is made for fair use of
celebrity or political figures and/or satire.
In English, please?
The first part is self-evident.
When you submit work, you promise that you created
it and that you have the right to offer it for publication.
The second part refers to slander
and libel or unfair depiction of private persons. This
is not likely to be a problem, but if your ex reads
our site and thinks that the nose-picking pedophile
in your story bears a striking resemblance to himself,
you're on your own.
Payment is delivered via Paypal
only. It is the responsibility of the author to provide
a valid Paypal e-mail address to Big Pulp so that
payment can be remitted. Paypal fees are the responsibility
of the author.
As a start-up zine, we
have a limited budget and do not have a checking
account. We are handling all outgoing expenses electronically.
Payment is made via Paypal prior
to the publication date above, usually on the Sunday immediately
preceeding publication on the web (ie : the date the work
appears on the web, not the date of the PDF release).
We remit payments once a week, prior to the date your work appears
on the website. This will usually occur on Sunday.
It is possible your work may
be available in the PDF version prior to being published
online, but we pay by the date your work becomes
available online. The publication date will be noted
in the agreement.
